Main Applicable Regulations

TRCU021/2011: Regulations on food safety, applicable to the production, manufacturing, storage, transportation, sale, and disposal of food. However, it does not apply to food produced by citizens on their personal land for gardening or livestock farming, nor to food intended solely for personal consumption and not intended for circulation or sale within the EAEU customs territory (including its production, manufacturing, storage, transportation, and disposal processes).

TRCU029/2012: Regulations specifying safety requirements for food additives, flavourings, and technical aids.

TRCU005/2011: Regulations concerning food packaging safety. If a company engages in the production or supply of product packaging and exports it to the territory of the Eurasian Union, it is mandatory to apply for an EAC conformity declaration to prove that its products comply with the regulations. However, packaging for tobacco products, medical devices, pharmaceuticals, and hazardous materials is not subject to these regulations.

Definition and Identification Methods of Food

Food Definition

Food refers to natural, processed, or processed forms of animal, plant, microbial, mineral, artificial, or biotechnological products intended for human consumption, including specialised foods, drinking water, drinking water packaged in containers, mineral water, alcoholic beverages (including beer and beer-based beverages), soft drinks, bioactive food additives (BAA), chewing gum, yeast and microorganisms, yeast, food additives and seasonings, and food ingredients. However, unprocessed animal-derived food (fresh or live), specialised food, and vinegar are excluded.

Identification Methods

Food can be identified using the following methods:

Name: Identify based on the specific name of the product.

Visual Method: Identify by directly observing the product's appearance, colour, shape, and other characteristics.

Sensory Method: Use human senses such as smell, taste, and touch to assess the product's characteristics.

Analytical Method: Use professional analytical testing methods, such as chemical analysis and microbial testing, to determine the product's composition and quality.

Certification and Declaration-Related Matters

EAC Conformity Declaration

Unprocessed animal-derived food (fresh), specialised food, and novel food may obtain an EAC conformity declaration (3d model) based on their own evidence and evidence obtained with the participation of a third party. Technical regulations for specific types of food may establish other EAC certification conformity declaration programmes.

EAC Certification Conformity Assessment

EAC certification conformity assessment for non-industrial food products prepared for sale and food products from public catering establishments, as well as the sales process for specific food products, is conducted under national supervision (control) and must comply with the requirements of TRCU021/2011 and the technical regulations of the Customs Union for certain specific types of food products.

National Registration of Special Food Products

Types of special food products requiring registration

Infant food: including drinking water for infant food.

Foods for dietary therapy and dietary prevention of nutrition.

Mineral water-related: Medical mineral water, mineral water with mineral content exceeding 1 mg/dm³ or mineral water with lower mineral content containing bioactive substances meeting or exceeding preservation standards.

Nutritional foods for specific populations: Foods for the nutrition of athletes, pregnant women, and lactating women.

Bioactive food additives: (Nutritional Health Products BAA).

Validity Period of Registration Certificates

The validity period of the national registration SGR certificate for special foods is unrestricted and is 5 years.

National Registration of Production Facilities

Types of production facilities requiring registration

Animal slaughter and processing: Slaughter of production animals and poultry, and processing of slaughtered products from production animals and poultry for food production.

Dairy product production-related: Reception of raw milk, raw cream, and raw skimmed milk, and processing of dairy products.

Poultry egg production: Production of poultry eggs and their processed products.

Aquaculture and fishing: Production and processing of aquaculture products (excluding plant products) and the catch of aquatic biological resources (non-fish catch objects).

Registration-related regulations

National registration of production facilities is conducted by the registration authority of the production facility based on an application submitted by the business participant at the location where food production is planned to commence, and is not subject to a validity period. Participants in economic activities have the right to apply to the national control and supervision authority for SGR national registration of food production and manufacturing activities, and upon registration, are entitled to engage in food production and manufacturing activities. Additionally, in accordance with the regulations of the Eurasian Economic Union (EAEU) member states, food production, manufacturing, storage, transportation, sales, and disposal processes must be strictly controlled and supervised in accordance with the requirements of TRCU 021/2011.
